Please read these Terms of Use ("Terms") carefully before using the SmallHappen platform (the “Service”), operated by SmallHappen (“we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
Our Role
SmallHappen is an event discovery, booking, and payment facilitation platform.
All events listed on SmallHappen are created and operated by independent event organizers (“Organizers”). SmallHappen is not the organizer, host, or provider of any event.
We are not responsible or liable for:
- Event cancellations, delays, or changes
- The accuracy of event details provided by Organizers
- The quality, safety, legality, or execution of any event
All transactions are conducted directly between the Organizer and the attendee. The Organizer is the seller of record and solely responsible for fulfilling the event.
Tickets, Payments, and Refunds
When you purchase a ticket through SmallHappen, you are purchasing directly from the Organizer.
Organizers are solely responsible for:
- Setting ticket prices and policies
- Managing cancellations, postponements, and changes
- Issuing refunds where applicable
Refund eligibility is determined by the Organizer’s stated policy. SmallHappen does not guarantee refunds and is not responsible for issuing refunds.
Payments are processed through third-party providers, including Stripe, and are subject to their terms and conditions.
Disputes and Chargebacks
All transactions processed through SmallHappen are made directly between the attendee and the Organizer. SmallHappen acts solely as a platform provider and payment facilitator.
If you have an issue with your purchase, you agree to first contact the Organizer to seek resolution before initiating a payment dispute or chargeback.
By completing a purchase, you acknowledge and agree that:
- The Organizer is the merchant of record and is responsible for fulfilling the event.
- Disputes related to event quality, delivery, cancellations, or refunds must be directed to the Organizer.
- SmallHappen is not responsible for resolving disputes related to the underlying event.
In the event of a chargeback or payment dispute:
- The Organizer is responsible for responding to and managing the dispute.
- SmallHappen reserves the right to share transaction and booking details with payment processors, including Stripe, to assist in dispute handling.
- Fees, penalties, or losses arising from disputes may be passed on to the Organizer in accordance with applicable agreements.
Abuse of the chargeback process, including filing disputes without attempting to resolve the issue with the Organizer, may result in suspension or restriction of access to the SmallHappen platform.
Content
You may post or upload content to the Service (“Content”). You are solely responsible for your Content and its legality.
By posting Content, you grant SmallHappen a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such Content in connection with the Service.
Acceptable Use
You agree not to:
- Use the Service for unlawful, fraudulent, or misleading purposes
- Interfere with or disrupt the Service
- Access the Service through unauthorized means
Third-Party Services
The Service may contain links to third-party websites or services. We do not control and are not responsible for third-party content or practices.
Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis.
We disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and availability.
We do not guarantee that:
- The Service will be uninterrupted or error-free
- Events will occur as described
- Any information provided is accurate or complete
Limitation of Liability
To the maximum extent permitted by law, SmallHappen shall not be liable for any indirect, incidental, special, or consequential damages arising from:
- Use of the Service
- Participation in any event
- Transactions between attendees and Organizers
Our total liability shall not exceed the amount you paid through the Service in the past 12 months.
Indemnification
You agree to indemnify and hold harmless SmallHappen and its affiliates from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your events (if you are an Organizer)
Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws of the jurisdiction in which SmallHappen operates, without regard to conflict of law principles.
Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
